Es bastante probable que en un par de semanas sea suspendido por el Consejo General del Poder Judicial como juez de la Audiencia Nacional. Los callos que ha pisado durante el ejercicio de su profesi?n y su breve paso por la pol?tica le han granjeado no pocos enemigos y rivales que seguramente van a acabar con su fulgurante carrera nacional e internacional. Las reacciones fuera y dentro del pa?s no se han hecho esperar, se est? desatando una ola de adhesiones por su trayectoria en la persecuci?n global de dictadores como Pinochet: Amnist?a Internacional, sindicatos, partidos progresistas, asociaciones de memoria hist?rica, las Abuelas de la Plaza de Mayo y magistrados progresistas de todo el mundo han cerrado filas con Garz?n.<\/p>\n<p>La verdad es que es duro reconocer que el superjuez sea la primera persona procesada por los delitos del franquismo en nuestro pa?s. Peor a?n es que los restos del franquismo pol?tico ?que en cualquier pa?s estar?an proscritos? hayan sido los que hayan promovido la denuncia por prevaricaci?n: Falange Espa?ola y de las JONS, Manos Limpias y Libertad e Identidad. El Partido Popular y la prensa de derechas, herederos ideol?gicos del franquismo, no esconden su satisfacci?n por el encausamiento.<\/p>\n<p>La base jur?dica para los cargos de prevaricaci?n es que la Ley de Amnist?a de 1977 cerraba cualquier v?a contra los asesinos y torturadores de la dictadura de Francisco Franco. Aunque no quieren reconocerlo as? es una aut?ntica ?ley de punto final? m?s propia de rep?blicas bananeras o de pa?ses que no han logrado zafarse del yugo del fascismo militar. Sin embargo, mientras decenas de miles de personas se encuentren tiradas en las cunetas de las carreteras de todo el pa?s, mientras que los asesinos sigan reconocidos en placas, monumentos, calles y plazas, no se podr? decir que la transici?n democr?tica burguesa ha acabado en nuestro pa?s.<\/p>\n<p>Por contra, Baltasar Garz?n se apoya en que Espa?a es signataria de un convenio internacional amparado por Naciones Unidas que obliga a incorporar delitos como la desaparici?n forzosa como crimen de lesa humanidad imprescriptible dentro de su ordenamiento jur?dico por muchas leyes de punto final que los dictadores obligaran a firmar a la clase pol?tica durante la transici?n o aunque dejaran a un militar (Juan Carlos de Borb?n) al frente del estado como herencia m?s directa de la dictadura.<\/p>\n<p>Sin embargo, no todo es blanco o negro. ?Garz?n, a pesar de de luchar contra los dictadores en todo el mundo bas?ndose en la jurisdicci?n universal que ten?a nuestro ordenamiento sobre cr?menes contra la humanidad, ha colaborado activamente contra la criminalizaci?n del independentismo vasco, ha liderado detenciones arbitrarias y ha cerrado medios de informaci?n a trav?s de la aplicaci?n de autos ?conocidos como garzonadas? fundamentados en base a apreciaciones y oportunidades pol?ticas m?s que en normas jur?dicas que, cuando se han revertido en otras instancias, ya hab?an conseguido el fin pol?tico para el que dictaron.<\/p>\n<p>Una aut?ntica guerra sucia en nuestro pa?s alternada con la persecuci?n de varios dictadores latinoamericanos. Ese es el perfil del juez que hoy est? en boca de todos. Aunque no me agrade lo que est? sucediendo estos d?as, tampoco voy a llorar su m?s que probable suspensi?n.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Al juez estrella se le apag? la suya.
