El Tribunal Constitucional ha desecho la grave vulneraci?n de las libertades fundamentales que imped?an a los miembros de Sortu crear un partido pol?tico a pesar de que rechazaban el recurso a la violencia y proclamaban la lucha por la independencia de Euskadi por m?todos absolutamente pac?ficos. Aquello fue una ilegalizaci?n preventiva, tomada sin ning?n tipo de base jur?dica, sin ning?n tipo de prueba fehaciente, otro dislate m?s a los que nos tiene acostumbrado la curia leguleya con reminiscencias franquistas que machaca nuestro pa?s. Lo hicieron simplemente porque no se cre?an o no se fiaban de lo escrito en los estatutos de la formaci?n, un texto que copiaba ?ntegramente la Ley de Partidos, por lo que sus se?or?as se situaban claramente a la altura de una rep?blica bananera cualquiera.<\/p>\n

Esta vez en TC ha dado marcha atr?s a aquella decisi?n absolutamente pol?tica. Otras veces han podido mantener decisiones imjustas del Supremo y de la Audiencia Nacional encontrando alg?n clavo ardiendo jur?dico para revestir sus fallos de apariencia legal. Esta ha sido muchas veces la t?ctica usada por Garz?n y otras lumbreras del poder judicial: dictar sentencias a sabiendas de que son injustas y que ser?an anuladas en instancias superiores ya que, en el tiempo que duraba la resoluci?n de los recursos, hab?an cumplido de sobra su cometido. Recordemos por ejemplo el caso Egin o muchas otras garzonadas, que era como se conoc?an a los autos bananeros del juez estrella, que bien podr?an haberlo apartado de la carrera judicial ?y no s?lo a ?l? por flagrante prevaricaci?n en el tratamiento al independentismo vasco. Salvando las distancias, es lo mismo que ha hecho el gobierno del PP al privar a Amaiur de formar grupo propio en el parlamento espa?ol, cuando los tribunales revoquen la medida, ya se habr? privado de parte del ejercicio de la palabra a unos representantes electos en una contienda electoral libre en buena parte de la legislatura<\/p>\n

Ya es hora de que se castigue a aquellos que recurren torticeramente a la justicia con fines manifiestamente pol?ticos. Si a sus se?or?as no les saliera gratis, si pagaran de alguna manera las costas de sus decisiones arbitarias, seguramente el panorama judicial ser?a bien diferente.<\/p>\n
